Can public schools now ban blacks?

That would appear to be one unintended legal consequence of the recent 9th Circuit Court's decision concerning limits on the freedom of expression:
Officials at a Northern California high school acted appropriately when they ordered students wearing American flag T-shirts to turn the garments inside out during the Mexican heritage celebration Cinco de Mayo, a federal appeals court ruled Thursday.

The 9th U.S. Circuit Court of Appeals said the officials' concerns of racial violence outweighed students' freedom of expression rights. Administrators feared the American-flag shirts would enflame the passions of Latino students celebrating the Mexican holiday. Live Oak High School, in the San Jose suburb of Morgan Hill, had a history of problems between white and Latino students on that day.

The unanimous three-judge panel said past problems gave school officials sufficient and justifiable reasons for their actions. The court said schools have wide latitude in curbing certain civil rights to ensure campus safety.
There is even less question of the connection between blacks and racial violence than American flag T-shirts and racial violence. So, now that we know "concerns of racial violence" supersede the 1st Amendment in public schools, it should be obvious that they must supersede every other Constitutional and legal stricture as well.

That's an incantation to which everyone should learn to resort. "I'm sorry, I fear racial violence on the basis of past problems." It's a free legal pass to restore freedom of association.

In fact, Live Oak High could probably cite this decision in refusing to permit Hispanic students to attend school on Cinco de Mayo. Or, as is more likely the case, white students.

Logically, it still doesn't follow. The order doesn't ban students, just freedom of expression. Thus, the best way to make officials at the high school to take notice is to insult the Cinco de Mayo celebration in sufficient display to make them withdrawal it. Ban the freedom of expression for all. Parents can take the initiative by claiming racial violence via the court judgement to keep their kids at home. The loss of money from attendance is enough to give the officials second thoughts.

It really is the Grand Inquisitor writ large. Christ (or in this case the Constitution) gave us freedom, and we've been begging ever since to throw away that freedom in exchange for security.

Give people a choice between feeling safe and being free, and they will choose to feel safe every time.

The only problem is that as soon as they've given up all their liberty, they are anything but safe.

No free speech in schools lest it incite violence? Why stop with schools? If that logic applies, surely it must extend to venues other than just schools. Yes, the courts have found that students don't enjoy the full free speech protections that adults normally enjoy, but I'm sure we can multiply the exceptional situations now that one exception has been grossly made.

Also, even for those bastardized year-round schools, the holiday takes place within an officially approved summer break period, so the issue luckily never comes up.

This may be the beginning of the end for Public Schools. Think about it. They now have the authority to ban members of a certain race for fear of racial violence. Since school administrators will not ban blacks or Hispanics due to fears of being called racist, they will instead ban whites and Asians.

You know, the ones who are higher achievers anyway. With so many high achievers finding alternative paths to learning, suddenly parents start to question why their tax dollars are paying for gangs to sell drugs and start turf wars on government property.

This is probably an optimistic viewpoint though.

I graduated from Live Oak in 85. Even back then there was strife between the Hispanics and Whites. Back then it was termed "Cowboys vs Mexicans". In the last 25 years the area has become more pacified (if that is the right term) and "diversity" has become predominate.

About the school mascot, the "Acorn". We hated it back then, and the current students hate it now. The saying "Live Oak Acorns, we're a bunch of nuts" still holds true.

Wear Cinco de Mayo t shirts with a circle and slash on it on May fifth, wear a red t shirt with a picture of Stalin on it with the words "I am a Communist" and "100 million served" also on it. Wear a t shirt with a picture of Hitler and a swastika and six million served and "I am a Nazi" on it. I have become a solid proponent of segregation. Further, I believe "unfair" laws are just, when there is no evidence that there is a balance. If certain populations cannot hold themselves accountable, then laws should be enacted that do. But the whole population should not unduly suffer for the least among them.

As for keeping blacks out of public schools, how about ending public schools and leaving that to the parents, where it belongs? That is how I would deal with that, though segregation and some other things would be fine if that is too big of a bite up front.

The nice thing? I don't have to push for this. Actually, if I wanted to get to it faster? I would support the current regime, full stroke. They are getting things back by destroying things as they are faster than anything I could hope to create and deploy. The problem? I have objective principles that restrict my logic. So... I'll continue fighting the inevitable.

Protecting your own people??? Go figure. What a novel idea. American leaders should try it once in a while. I just laminated some posters yesterday that gave a phone number for any complaints Chinese and Spanish speakers might have over lack of services in said languages in all Oakland city depts. Such services are now mandated by city charter. In fact, it is the policy of the City of Oakland to eventually replace all workers with Spanish and Chinese speakers.

Cowards...Conservatives are such plain cowards, it's no wonder the country is lost. Did I miss somewhere where conservatives did more than whine about their diminishing power and actually staged a demonstration at the school and the court and simply made clear that the ruling was unacceptable and would not be recognized?

Since the issue is a non-US holiday being celebrated in US schools, perhaps the solution would be to celebrate another non-US holiday

Celebrate Camarone week starting on 30 April through 6 May. Play “Le Boudin” the Foreign Legion theme, and “Le Marsellaise” on school loudspeakers. Wear Tri-color flags and Kepi-blanc. Students of French, German, Polish, Russian, Spanish and Italian heritage can all participate since that was the ethnicity of the Legion in the day. Thing is, Ukrainians are not his people. It'd be akin to Quebecois being sent to curb protests in D.C., then labeling the protestors as thieves and criminals.
